1. Who we are
This Way Up is operated by This Way Up Distribution Ltd, a company registered in England & Wales. Registered office and Companies House number are published on our Contact page. In these Terms, “we”, “us”, and “This Way Up” mean This Way Up Distribution Ltd; “you” means the person using the site.
2. What This Way Up does
This Way Up is a UK property discovery and communication platform. It lets you:
- browse a map of UK properties;
- express interest in a specific property by dropping a pin;
- send a printed postcard to that property’s postal address;
- receive an in-app reply from anyone who claims the address.
We are not an estate agent. We do not market properties on behalf of sellers, take instructions to sell, hold client money, or negotiate offers. We are an infrastructure layer that connects potential buyers and occupants. Any resulting sale, tenancy, or negotiation is between you and the other party.
3. Account
You can browse without an account. Sending a postcard or replying to one requires an account, which we provide through Clerk. You agree to give accurate information, to keep your credentials secure, and to tell us promptly if you think your account has been compromised.
4. Postcards
When you buy and send a postcard, we print it, envelope it, and post it via our fulfilment partner (currently Stannp) to the postal address you selected on the map. Once we have dispatched the print job, the postcard cannot be recalled. Delivery times and postal reliability are outside our control.
Cooling-off: under the Consumer Contracts Regulations 2013, you normally have 14 days to cancel a distance-purchased service. By tapping Send postcard, you expressly ask us to begin the service immediately and acknowledge that you lose the right to cancel once the postcard has been handed to our fulfilment partner. Refunds for postcards that were paid but not yet handed to the fulfilment partner are available on request.
Content rules. You are responsible for the message you send. You must not use postcards to harass, threaten, defraud, defame, or unlawfully profile anyone. We may refuse to dispatch a message that in our reasonable view crosses those lines, and we will refund the postcard fee if we do.
5. Property claims and opt-outs
The occupant, owner, or authorised representative of a property can claim it on This Way Up. Once claimed, replies to incoming postcards are delivered through the platform to the claimant.
Anyone associated with a property can also request that we opt the property out from receiving postcards. Opt-outs are permanent for the postal address, take effect within 24 hours, and are enforced at print time. To opt out, email claims@thiswayup.com from an address you can verify against the property, or use the opt-out link on any postcard you have received.
6. Data we hold about you
See our Privacy Policy for the full detail. In short: we store the pins you drop, the postcards you send, the messages you write, and the standard account metadata (email, sign-in provider). Payment details are held by Stripe, not by us.
7. Fees and payment
Prices for postcards and other paid features are shown at the point of sale and include VAT where applicable. Payment is taken by Stripe. Refunds are issued to the original payment method within 14 days of an approved request.
8. Availability
We aim for high availability but do not promise it. Planned maintenance, third-party outages (Stripe, Clerk, Neon, Cloudflare, Stannp, Royal Mail), or emergency changes can interrupt the service. We publish current status at status.thiswayup.com.
9. Acceptable use
You must not:
- scrape or otherwise systematically extract map data or postcode boundaries;
- use the postcard channel to send bulk unsolicited commercial mailings;
- impersonate another person when claiming a property;
- circumvent an opt-out on a property.
Breaching this section may result in your account being suspended and any postcards in the print queue cancelled and refunded.
10. Our liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under English law.
Subject to that, our total liability to you for any claim arising out of your use of This Way Up is limited to the greater of (a) £100 and (b) the total fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for any indirect or consequential loss, or for loss of profit, revenue, opportunity, or goodwill.
11. Changes to these Terms
We may update these Terms. If a change is material we will notify signed-in users by email or in-app message and give at least 14 days’ notice before it takes effect. Continued use after the notice period counts as acceptance.
12. Governing law
These Terms are governed by the laws of England & Wales. Disputes may be brought before the courts of England & Wales, without prejudice to any mandatory consumer protections available to you in your country of residence.
